Boyertown School Bus Driver Charged in DUI Case Scheduled for August Court Hearing

A Boyertown woman accused of driving a school bus while heavily intoxicated with 54 children on board is scheduled to return to court next month in Montgomery County.

Kelly Weber, 46, faces 221 criminal charges, including multiple counts of endangering the welfare of children and recklessly endangering another person, according to court records.

A pre-trial conference is scheduled for Aug. 14, when prosecutors, defense attorneys, and the judge will discuss the status of the case, including whether it could be resolved through a plea agreement or proceed to trial.

The charges stem from an incident on Feb. 6 in Douglass Township. Authorities allege Weber drove erratically while transporting 54 students, repeatedly crossing the double yellow line and entering oncoming traffic. According to investigators, several children texted their parents during the trip, expressing fear and reporting that the driver appeared to be falling asleep.

Investigators also allege surveillance video from inside the bus showed Weber drinking from a vodka bottle while driving.

According to the Montgomery County District Attorney's Office, testing later determined Weber's blood alcohol concentration was 0.331%. Under Pennsylvania law, the legal blood alcohol limit for commercial school bus drivers is 0.02%.

Following the incident, Weber entered a rehabilitation facility before surrendering to authorities. She was arraigned on June 3 and released after posting $50,000 bail. As conditions of her release, she is prohibited from driving, having unsupervised contact with children, and must continue recommended treatment.

The incident has also prompted proposed legislation in the Pennsylvania Senate. State Sen. Tracy Pennycuick has introduced a bill that would increase penalties for bus drivers convicted of driving under the influence of alcohol or drugs.
